Commission Terms and Conditions

Please read the following completely to understand my terms and conditions. When placing an order, you are agreeing to these terms and conditions.

  1. This is a personal commission only and can not be used commercially anywhere in the world. You are to only use it for your own personal interests. E.g. printing a copy for yourself to display in your home is fine - printing a copy/copies to sell and distribute is not.

  2. All art varies and unfortunately, so does my style. I will do my best to make sure that the artwork created will match the style displayed above as best as possible.

  3. All payments are upfront - this is non-negotiable. However, if for whatever reason I can not complete a commission, payment will be refunded to the extent of work completed. (E.g. I was 50% complete, but I can no longer complete the artwork, therefore, 50% of the payment will be refunded)

  4. I WILL NOT DRAW: Hentai, Porn, Lewds, Animals, Mecha, Graphic Design, Commercial Illustrations. (If you are interested in Commercial illustration or Graphic Design work, please use the contact form! Book Illustration/ Twitch / Youtube / Professional PFPs are all considered commercial and therefore there may be an inclusion of Licensing fees. I am more than happy to negotiate and discuss.

  5. My preferences for drawings are: Fanart from pre-existing series, humanoid characters (Anthropomorphic elements like ears, tails, teeth are fine! I am inexperienced in some areas such as Furry art and real people so please be aware of that if you are considering this kind of work!), pin-up style, modern fashion styles, fluffy hair and androgynous looking characters. This doesn’t mean I won’t do anything that isn’t my preference (on the contrary!) but It just means that I can guarantee the quality due to my own interests / experience.

  6. Lead time is usually 2-4 weeks depending on the state of my affairs. I work a heavily busy full-time day job in Marketing and it can at times, invade my down time. No matter what however, I will always communicate with you if something comes up and there may be a delay. If I’m in a good place, it can even take a week but I wont guarantee that.

  7. I keep 2-3 slots going at any one time. (PenPal Presale is the exception) This is to make sure I don’t have clients waiting for too long after payment. Please be patient if they run out. Twitter / Instagram will be updated whenever there are additional slots or when something opens up. They are FIRST COME FIRST SERVE upon payment. The first to find out about slots will always be PenPals, then those of you who have subscribed to Penguinsbite’s Twitch / newsletter (bottom of page) and then finally twitter / instagram!

  8. I have 3 commission styles at the moment -
    Style A has sketched lines and limited colour flats in its design.
    Style B has full colour and has a painted render style.
    Style C / Full illustration is pretty much a ‘commercial illustation’ without it being ‘commercial’. I will put the character in a space with a background / foreground, potentially with lighting - it may even tell a slight narrative, have a theme or specific vibe.

    If you are wanting to commission emotes, Twitch art, PFP for a professional social media account etc, please fill in the form and I’ll still consider doing it (but it won’t be considered a personal commission).

  9. I will likely stream some part of the commission. Streaming often motivates me to work when I’m not 100% feeling like doing so, therefore, your commission may appear in a Twitch stream or in social media. If for any reason you would prefer not to have me stream the process, please answer so in the form.

  10. I will use the artwork to promote my own professional work during and after completion. I reserve the right to do so however if there is a reason that you would like this delayed (its a birthday present for eg), then let me know in the final section of the order form and I can arrange something.

  11. I may use the sketches and artwork in zines / artbooks etc in addition to use in promotional and marketing. However it will never be the sole focus of the product (E.g. May be 1 page in a 4 page artbook).

  12. The artwork will not be turned into merchandise (e.g. stickers, prints etc) without the full written agreement from the client!

  13. There may be additional costs if the outfit is incredibly complicated or the background is excessively detailed, so please keep this in mind.

  14. I will always retain copyright of the specific commission artwork. This is not a right over your character or the content requested within the commission but that sole piece of artwork itself.

  15. You are NOT to turn the artwork into an NFT (Non-Fungible Token) under any circumstances.
